Liability Waiver & Release Form

In consideration of being permitted to participate in any fitness classes, training sessions, spinning classes, or any other activities offered by Unstoppable Fitness LLC ("the Company"), located in Elkhart, Indiana, I, the undersigned participant, hereby agree to the following: 1. ASSUMPTION OF RISK I acknowledge that participation in fitness activities, including but not limited to spinning classes, group fitness, personal training, and any related activities, involves inherent risks of physical injury, including but not limited to muscle strains, sprains, fractures, cardiovascular events, and in extreme cases, death. I voluntarily assume all risks associated with participation in these activities. 2. RELEASE OF LIABILITY I hereby release, waive, discharge, and covenant not to sue Unstoppable Fitness LLC, its owners, officers, employees, agents, instructors, volunteers, and representatives (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in any activity offered by Unstoppable Fitness LLC, whether caused by the negligence of the Released Parties or otherwise. 3. MEDICAL CONDITIONS I certify that I am in good physical condition and have no medical conditions that would prevent me from safely participating in fitness activities. I acknowledge that Unstoppable Fitness LLC is not a medical facility and its staff are not medical professionals. I agree to consult my physician before beginning any exercise program. I take full responsibility for my health and well-being during participation. 4. INDEMNIFICATION I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in any activity offered by Unstoppable Fitness LLC, whether caused by the negligence of the Released Parties or otherwise. 5. PHOTO/VIDEO RELEASE I grant Unstoppable Fitness LLC permission to use my likeness in photographs, videos, or other digital media for marketing and promotional purposes without compensation. 6. RULES AND REGULATIONS I agree to follow all rules and regulations set forth by Unstoppable Fitness LLC and its instructors. I understand that failure to comply may result in removal from class without refund. 7. GOVERNING LAW This agreement shall be governed by the laws of the State of Indiana. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. 8. ACKNOWLEDGMENT I HAVE READ THIS LIABILITY WAIVER AND RELEASE OF ALL CLAIMS, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY, AND INTEND BY MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
